We appreciate your interest in our website and the regulations on dealing with recordings and transcriptions of online meetings via Microsoft Team (“MS Teams”) at Agamus. The protection of your personal data is very important to us. The following provides information on how we handle your data.

3. Scope of Application 

 

3.1. Website 

This privacy statement applies to our website www.agamus.com and, where applicable, to other sites offered by us, if they refer to this privacy statement. 

The privacy statement does not apply to websites of third parties, in the following cases: 

  • Websites of third parties which are independent of the website www.agamus.com and contain a link or a search form that refers to our website; 

  • Websites of third parties which are independent of the website www.agamus.com and are opened via a link 

  • Partner sites of www.agamus.com that have integrated one of the services on their own website (co-brandings) 

  • Partner sites of www.agamus.com, accessed through integration in one of the services offered (co-branded sites)

3.2. Transcriptions of Online Meetings 

This privacy statement is also applicable to the processing of personal data in the scope of transcriptions of online meetings via Microsoft Teams (“MS Teams”) and the usage of data arising from them.  

4. Visit to the Website 

4.1 Access data 

You can visit our website without providing any details about yourself. We only collect access and navigation data such as IP address, date and time of the request, time zone difference to GMT, content of the request, access status, transmitted data volume, website from which the request was received, language and version of the browser and operating system. These data are only evaluated to ensure proper operation of the website and to optimize our offer and, are deleted afterwards. 

4.2 Use of Cookies 

We use cookies to ensure a simple and practical use of the website. These are small text files that are stored on your device and store certain settings and data for exchange with our system via your browser. 

When you visit the website, our system sends cookies to your device. Cookies alone do not identify you personally but only recognize your web browser. As long as you do not reveal your identity to us, e.g. through registration or by completing a web form, you remain anonymous. 

We use session cookies. Session cookies are only retained for one session. When you exit your browser software or turn off your device, these cookies are removed from your device. If you disable the storage of cookies in your browser, you can still use the site. Deactivation of cookies may, however, lead to a limited functionality of the website and its use.

4.2.1 Necessary cookies 

These cookies are necessary to enable the operation of the website. This includes, for example, cookies which enable you to log into the user area. 

4.2.2 Analytical Cookies 

These cookies allow to collect anonymous data about the usage behavior of the users. These are evaluated, e.g. to improve the functionality of the website and to provide you with offers where appropriate. 

4.2.3 Functional Cookies 

These cookies are used for certain functionalities of the website, e.g. to suggest a better navigational flow, or to provide you with personalized and relevant information. 

4.2.4 Targeting Cookies 

These cookies record your visit to the website, the pages you have visited, and the links that you have activated. We use this information to adapt our website and the displayed advertising to your interests. 

4.2.5 Third Party Cookies 

These cookies of some of our partners help to make the website more interesting for you. Therefore, cookies from partner companies are also stored on your device during your visit to our website. These are temporary cookies which are automatically deleted after the specified time. Cookies from partner companies are usually deleted within a few days or up to 24 months, in individual cases even after several years. Cookies of our partners do not contain any personal data. Only pseudonym data are collected under a user ID. These pseudonymous data will never be merged with your personal data at any time. 

4.2.6 Configuring the Cookie Settings in your Browser 

The browsers differ in their way how the cookie settings are managed there. These are described in the help menu of the respective browser. 

4.3 Use of analytical Tools; Right of Objection 

Our website uses the web analytics service Matomo. Matomo uses so-called »cookies« which allow an analysis of the use of the website. The usage information (including your abbreviated IP address) generated by the cookie is transferred to our system and stored and used for the purpose of advertising, market research or the appropriate design of the website. Your IP address will be anonymised during this process so that you remain anonymous to us as a user. You can prevent the use of cookies by means of an appropriate setting in your browser. If you do so, you might not be able to make full use of all the functions on this website. 

If you do not agree to the storage and evaluation of this data, you can always object to the storage and use at any time by a mouse click. In this case, a so-called opt-out cookie is stored in your browser, which means that Matomo does not collect any session data. If you delete your cookies, this means that the opt-out cookie is also deleted and must be activated again as necessary. 

Your visit to this website is currently recorded by Matomo web analytics.

5. Registration for the Newsletter and Downloads; Logout 

You can subscribe to our newsletter or enter your details to download a document on the website. If you do so, we use the data you have provided with your consent to send you up-to-date information by e-mail. You can unsubscribe at any time, especially by using the unsubscribe option in the newsletter mails. 

If you have registered for our newsletter, we can forward your data required to send the newsletters to a service provider, if he is instructed to send the newsletters. 

6. Sending a Contact Request 

Personal data will be collected if you voluntarily communicate this to us during establishing contact or when registering for our services. We only use your data to provide you with the information or services you require, this means that only information and data are stored and processed that are necessary to answer your request or to perform the contractual relationship. If you contact us without concluding a contract of use, your data will be deleted from the database, if you wish. 

7. Recruitment 

If you submit a resume or job application online, we will use your Personal Data for recruitment-related purposes, which may include contacting you via email, telephone or post. Except where you request otherwise, Agamus Consult may keep your Personal Data on file for an appropriate time to consider you for other employment opportunities with Agamus Consult in the future. 

8. Changing and deleting Data 

You may change and correct or supplement at any time the data in your user account that you communicated during registration. Furthermore, your data will be deleted by us if you inform us of your request for deletion. When the data are completely deleted, however, the access to the parts of the website that are subject to registration also ends. Your data will also be deleted automatically when you unregister as a user and stop using the database. 

Data collected without registration will be deleted within the deletion periods provided for this purpose. 

The deletion of data takes place promptly after the end of the purpose for which they were collected, but not before the expiry of any statutory retention periods. 

9. Transcriptions of Online Meetings  

9.1. Purpose of Processing 

The transcription of online meetings is carried out for the following purposes: 

  •  Compiling of protocols and summaries 

  • Improvement of traceability and documentation of meetings 

  • Support with compiling of reports and analyses  

  • Usage of data to improve our services 

9.2. Legal Basis 

The processing of your personal data in the scope of the transcription is carried out based on your consent according to Art. 6(1)(a) GDPR. 

9.3. Information regarding consent 

The consent to the transcription will be obtained either at the beginning of or during the online meeting. You have the right to withdraw your consent at any time. Withdrawal means that we will no longer process your data for the above-mentioned purposes from that point on. 

9.4. Data Categories 

During the usage of “Teams” or “Office365”, several kinds of data are being processed. The scope of the data depends on the information you provide during an “online meeting.” It includes the following data: 

  • User, first name, surname, telephone(optional), email address, password (if “Single Sign-On” is not being used), profile picture (optional), department (optional), language
     
  • Online meta data: topic, description (optional), IP-addresses of participants, device/hardware information. For recordings (optional): MP4-file of all videos, audio, and presentation recordings, M4A-file of all audio recordings, text file of the chat of the online meeting. Dial-in with telephone: Information about incoming and outgoing phone numbers, country name, start and end time. If necessary, additional connection data such as the device's IP address can be stored. 
     
  • Text, audio and video files: during the usage of the chat, question or survey feature as well as other features for the up- or download of files like graphic, audio, video or office data, the data made accessible by you are being processed, in order to make them visible during the “online meeting” and to make then accessible to other participants during or after the meeting and to minute it, if necessary. During the meeting, the data are processed through the microphone or the camera of your device. You can mute or deactivate the camera or the microphone yourself at any time via the “Teams” applications.
     
  • Other Office 365 cloud services: Data stored by the user in these services is only stored for the purpose specified by the user for further processing or disclosure.
     
  • Scope of processing: We use Microsoft Teams to conduct online meetings and Office 365 to provide other Microsoft cloud services. We will communicate any recordings transparently in advance and, where necessary, ask for consent. The recording will be displayed in Microsoft Teams. In these cases, we are interested in the effective organization of online meetings and communication between meeting participants. 

According to the user instructions, the meeting organizer verbally informs participants before the recording begins that they can turn off their camera or use the chat function if they do not want their face/voice to appear in the recording. 

9.5. Personal Data 

When an MS Teams meeting is recorded or transcribed, we process the personal data of the individuals participating in that meeting.   

This may concern the following individuals: 

  • Employees 

  • Clients 

  • Other external participants 

The personal data, that is processed during a MS-Teams recording or transcription, refers to the people attending the meeting, by their presence.  

9.6. Data Processing outside the European Union 

“MS Teams” and “Office 365” are services provided by providers in the USA. Personal data is therefore also processed in a third country. An adequate level of data protection is ensured by the conclusion of the EU standard contractual clauses. 9.7. Storage Duration 

The recordings (transcripts) of the online meetings will be stored for a period of 180 days and then deleted, provided that there are no legal retention requirements. 

9.8. Access 

Access to the transcripts is restricted to authorized persons who need this data to perform their duties. The data will only be disclosed to third parties if this is necessary to fulfil the above-mentioned purposes or if there is a legal obligation to do so. 

9.9. Information on AI-supported processing 

Online meetings can be transcribed using AI-supported technologies. These technologies help us to create transcripts quickly and accurately. We ensure that all data protection regulations are complied with, even when using AI-supported technologies. 

If you have any questions about the processing of your personal data or to exercise your rights, you can contact our data protection officer at any time. 

10. Disclosure of collected Data, Consent and Revocation 

If necessary, we will pass on data to the service providers assigned by us so that they can provide services on our behalf as part of the operation of the website and within the scope of the services offered by us. We will also pass on the personal data to companies assigned by and connected with us to optimize our services and offers. 

Otherwise, we only pass on personal data if this is legally permissible or in compliance with a legal obligation, or if you have given your consent for this. Your consent may be revoked by you at any time with future effect.
